Philip Seaton, 61, and his wife have filed a suit in Kentucky State Court seeking unspecified compensation for removal of his penis in what was supposed to be circumcision for better treating inflammation. They claim that the penis was removed without consulting either Phillip or Deborah Seaton, or giving them an opportunity to seek a second opinion.
Seeking unspecified punitive damages for ‘loss of service, love and affection’ from Patterson and the medical practice – Commonwealth Urology, the Seatons are also suing Dr. Oliver James – Anaesthesiologist for use of general anaesthesia, when Seaton had specifically asked for it not to be administered.
While, messages left at Commonwealth Urology for Seaton and at Shelbyville for James are not being returned, Kevin George, attorney for Seaton says Dr. Patterson’s post surgical notes state the doctor, detecting cancer, removed the penis. Though later tests confirm Seaton did, indeed, have cancer, according to George, it was not an emergency and the doctor could have waited to discuss the issue with the couple.
In a similar suit, the court awarded $2.3-million in damages to an Indianapolis man, who claimed his penis and left testicle were removed without consulting him when he was operated upon for an infection in 1997.
