New York artist `allowed to paint nude models after dusk`

New York, Oct 14 : The New York City authorities have reached an agreement with a body artist, allowing him to paint nude models only after dusk.

The agreement, approved by city lawyers and prosecutors, states that Andy Golub will be allowed to paint topless, but not bottomless, women all day long, subject to any crowd control issues.

Golub was arrested in July on charges of misdemeanor public lewdness as he finished painting two nude women in Times Square.

“It’s a compromise that is allowing Andy to paint, and the police to do more important things -- although less fun,” the New York Post quoted the defense lawyer Ronald Kuby as saying.

A Manhattan judge has ruled that the charges against Golub will be dropped if he is not rearrested in six months and he sticks to the agreement.

According to Kuby, full public nudity is allowed in New York City only when it is a part of play, performance, exhibition or show. Although there is no law which specifically bans nude body painting but the city official have the authority to set what are called time, place and manner restrictions, banning nudity, for instance, at times or places when very young children might see it.
