Apple appeals Tokyo District Court’s ruling for Samsung in patent lawsuitIn what marks the latest development in the ongoing high-profile Apple-Samsung patent-infringement lawsuit, Apple has appealed an August 31 verdict by a Tokyo District Court which ruled that Samsung had not violated some of Apple's utility patents.

According to a Bloomberg report, Apple's Monday-filed appeal of the Tokyo ruling has come in the wake of the fact that the court's verdict implied that Samsung had not infringed Apple's patents pertaining to technology for synchronizing music and video data with servers.

Moreover, Apple decision to appeal was also apparently the company's response to the fact that, in addition to marking a triumph for Samsung, the Tokyo Court's verdict - handed out by Tokyo District Judge Tamotsu Shoji - had also led to a subsequent order which required Apple to pay legal fees linked to the lawsuit.

Noting that Samsung's Galaxy line of devices - including the Galaxy Tab - had not infringed on Apple's JP Patent No. 4,204,977, Judge Shoji said at the time of the August 31 ruling: "It's hard to believe the products belong to the range of technologies of the claimant."

With the Tokyo Court having turned down Cupertino, US-based Apple's claims that its South Korean rival Samsung Electronics had violated its smartphone and tablet computer patent, Apple's appeal of the ruling means that the patent lawsuit - in which Apple is demanding 100 million yen in damages from Samsung - will now go to the Intellectual Property High Court in Tokyo.
