New York's attorney general Files Lawsuits against Two Salon Chains

New York Attorney General Eric Schneiderman is filing a case against Total Tan. It has accused the company of ‘unlawfully concealing indoor tanning risks’.

On the other hand, Total Tan has filed a complaint against Schneiderman’s office. In the complaint, Total Tan has accused the officials of using an investigator whose husband was earlier for the tanning firm.

Attorney General Eric Schneiderman has also filed a lawsuit against Planet Fitness, which operates 101 gyms with tanning services in New York State. Schneiderman has accused Total Tan of false advertising by ‘denying or minimizing scientific evidence linking tanning to an increased cancer risk’.

In total, Total Tan operates 26 retail salons in Albany, Syracuse, Rochester, Buffalo, and Erie, Pennsylvania areas. The firm’s Syracuse–area salons are in DeWitt, North Syracuse, and Auburn.

Same accusations will also be made against Portofino Spas, LLC that operates five tanning salons in Manhattan. The lawsuit filed against Total Tan also unveiled that it asserts about the safety of indoor tanning in comparison to tanning outdoors.

Schneiderman’s office said that these legal actions are part of an effort to protect consumers from the documented-skin cancer risks of indoor tanning.

Total Tan has issued a statement, which stated that the Attorney General’s claims are not true. “We are a small, upstate, family-owned business that refuses to be intimidated by Mr. Schneiderman, who is trying to impose his own view of the world on our industry and the citizens of upstate New York”, further read the statement.

The company has claimed that Michael Pepe, a professor of business and marketing at Siena College, has stated that their advertising comports are within federal and state law.
